Terms of service

These Terms of service set out the rules for providing services by electronic means through the kontaktio.pl website.
The service provider is Kontaktio Bartosz Fiks, ul. Brzezińska 84, 95-020 Bedoń-Wieś, Poland, tax identification number (NIP) 7282909882, business register number (REGON) 544475638, e-mail kontakt@kontaktio.pl.
This is a translation provided for convenience. In the event of any discrepancy, the Polish version of these Terms of service prevails.
General provisions
These Terms apply to the services available on kontaktio.pl. Using the website constitutes acceptance of these Terms.
Definitions
- Website: kontaktio.pl together with its subpages.
- Service provider: Kontaktio Bartosz Fiks.
- User: a person using the Website.
- Electronic services: services provided by electronic means on the Website.
- GDPR: Regulation (EU) 2016/679 on the protection of personal data.
Types and scope of services
The Service provider offers in particular the following services:
- publishing information about the studio and its offer,
- contact through the contact form and by e-mail,
- presentation of completed projects,
- access to the client panel for people whose project the Service provider is running.
Technical requirements
Using the Website requires a device with internet access, a browser supporting HTML5, CSS3 and JavaScript, and an active e-mail account. The Service provider does not guarantee uninterrupted and fault-free access to the Website.
Client panel
The client panel is made available solely to people whose project the Service provider is running. Login credentials are issued by the Service provider. The User is responsible for keeping them confidential and undertakes to report any suspected unauthorised access without delay.
Rules of use
The following is prohibited:
- supplying unlawful content,
- disrupting the operation of the Website and its infrastructure,
- infringing the rights of third parties,
- attempting to gain unauthorised access to systems.
Intellectual property
Content published on the Website is protected by law. Copying, modifying or distributing it without the written consent of the Service provider is prohibited.
Personal data protection
The Service provider is the controller of personal data. Data is processed in accordance with the GDPR and the Privacy policy available on the Website.
Liability of the Service provider
The Service provider is not liable for interruptions in the operation of the Website caused by circumstances beyond its control, for damage resulting from improper use of the Website, or for the content of external websites linked from it.
Right of withdrawal
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for that person (an entrepreneur with consumer rights), may withdraw from a distance contract within 14 days of concluding it, without giving any reason.
To withdraw, it is enough to send a statement to kontakt@kontaktio.pl before the deadline expires. The statutory model withdrawal form (Annex 2 to the Polish Consumer Rights Act) may be used, but this is not mandatory.
If, at the express request of the withdrawing party, performance of the service is to begin before the withdrawal period expires, that party is obliged to pay for the services performed up to the moment of withdrawal. The right of withdrawal does not apply once the service has been fully performed, provided that performance began with the express consent of the withdrawing party, who was informed that this right would be lost.
Complaints
Complaints may be submitted to kontakt@kontaktio.pl. The Service provider examines complaints within 14 days.
Dispute resolution
Disputes are resolved primarily amicably, through direct contact with the Service provider.
A consumer may use out-of-court methods of handling complaints and pursuing claims, in particular: applying to the provincial inspector of the Trade Inspection to initiate out-of-court dispute resolution proceedings, applying to a permanent consumer arbitration court, and using the free assistance of a district or municipal consumer ombudsman or of a social organisation whose statutory tasks include consumer protection.
Detailed information on out-of-court methods of handling complaints and pursuing claims is available on the website of the Polish Office of Competition and Consumer Protection: uokik.gov.pl.
Using out-of-court methods is voluntary. If no agreement is reached, the competent court is the common court determined in accordance with Polish law.
Changes to the Terms
The Service provider may amend these Terms giving 14 days' notice. Continued use of the Website after the changes take effect constitutes acceptance of them.
Final provisions
Matters not covered by these Terms are governed by Polish law. If any provision proves invalid, the remaining provisions remain in force.
